Error from Doniphan District Court. The only questions here, are questions of practice, and the facts and proceedings necessary to a proper understanding of the case are stated in the opinion. Casey, as plaintiff, had judgment, at the June Term 1874, for $112.20, and costs, and the Railroad Company brings the cáse here on error.

1.Attachment; defendant. This action was originally commenced by Thomas Casey against the St. Joseph & Denver City Railroad Company before a justice of the peace. An attachment was issued in the case. From the record we learn that on the day set for trial the “Case was called, and parties appeared, and the defendant by its attorneys Messrs. Hawkins & Baldwin filed affidavit and motion to discharge the attachment issued in this case — motion was argued by counsel, and thereupon the said motion was overruled by the court upon the ground…
