Defendant and third-party plaintiff Charles G. Beemer (“Beemer”) appeals from an order dismissing his claims against third-party defendant Chatham Financial Group Limited Partnership (“Chatham”) for failure to state a claim upon which relief may be granted, pursuant to Rule 12(b)(6) of the North Carolina Rules of Civil Procedure. In addition, Beemer appeals from an order of the ■ trial court refusing to certify the order of dismissal as immediately appealable under Rule 54 of the Rules of Civil Procedure.
