MEMORANDUM OPINION

Plaintiff brings this case pursuant to 42 U.S.C. § 1983, alleging that Defendant violated his Fourth arid Fifth Amendment rights. Plaintiff has moved for partial summary judgment as to- liability on the Fourth Amendment claim, and Defendant cross-moved for summary judgment as to all counts. For the reasons below, Plaintiffs motion for partial summary judgment will be GRANTED, and Defendant’s cross motion for summary judgment on all counts will be DENIED.
