MEMORANDUM OPINION GRANTING DEFENDANTS’ MOTION TO DISMISS

This matter is before the court on Defendants’ Motion to Dismiss the Amended Consolidated Class Action Complaint [Docket No. 37; Filed May 11, 2012] (“Motion to Dismiss”). Plaintiff filed an Opposition to the Motion to Dismiss on June 25, 2012 [Docket No. 39], and Defendants filed a Reply on August 9, 2012 [Docket No. 41], Having considered the parties’ arguments, case pleadings, and relevant case law, the court finds that oral argument is unnecessary.
