(after stating the facts as above). The first question in this case is: Did the court below have jurisdiction thereof? The foregoing statement of facts demonstrates the conclusion that the real issue in the case was and is whether the Fryers were entitled to one-half of the surplus rents of the land under Dr. G. N. Fryer’s grant of November 13, 1913, and the compromise of 19Í6, in view of the reconveyance to him by the plaintiff and his granting on November 1, 1914, of all the surplus'rents to the plaintiff.
