By this application, plaintiff Charles Párente, Jr., as executor of the estate of Emily Wenger, deceased, and said plaintiff and others, as next of kin of said decedent, seek leave of this court to commence an action against the committee of Frank J. Wenger, an adjudicated incompetent who is the surviving spouse of Emily Wenger.
