The correct resolution in this case is almost reached by Justice Bakes in Part I of his opinion where he quoted from the decision of Judge George: “Hence one of the issues in this case is whether the City of Ammon could legally revoke the permits once issued.” In apparent recognition of the gross unfairness of the city’s action, Justice Bakes then writes that that issue has been decided against McQuillen, and this Court is powerless to rectify the outrage because McQuillen’s attorney has not depicted that as a “contention” in his appellate brief.
