This is a proceeding to obtain judgment against defendants for a deficiency after resale by the seller under the Conditional Sales Act of Indiana, Burns’ Indiana Statutes Annotated, Section 58-817, which is as follows: “If the buyer does not redeem the goods within ten (10) days after the seller has retaken possession and the buyer has paid at least fifty '(50) per cent of the purchase-price at the time of the retaking, the seller shall sell them at public auction in the state where they were at the time of the retaking, or at the place where the goods were sold; such…
