The present controversy arose out of an effort on the part of William A. Pease to foreclose a mortgage assigned to him by James H. Tallman, which had been executed in favor of the latter by Mary Y. Wagnon, as trustee for certain named persons. The plaintiff's petition was dismissed on general demurrer, and, upon exception taken, the judgment of the court below was reversed. See 93 Ga. 361.
