MEMORANDUM OPINION

MICHAEL, District Judge.

This case is currently before the court on the motion of the defendant, Badger-North-land, Inc., for summary judgment pursuant to Rule 56 of the Federal Rules of Civil Procedure. This motion was argued orally before the court by counsel for the parties on January 6, 1983, and in addition, the motion was briefed in numerous memoranda of law which the parties filed with the court.
