State of Washington v. Gary Lyle Stoddard

Court of Appeals of Washington

Decided January 12, 2016No. 32756-6-IIIPublishedCited by 24 opinions

1Opinion of the CourtFearing, J.

¶1 Following Gary Stoddard’s convictions for first degree murder and first degree kidnapping, the sentencing court imposed legal financial obligations, including a mandatory deoxyribonucleic acid (DNA) collection fee. Stoddard appeals the financial obligations. He argues that the trial court failed to address his current or future ability to pay the obligations. He also contends the mandatory DNA fee is unconstitutional when a court has not first determined the defendant has the ability to pay. We affirm Stoddard’s sentence.
