On January 30, 1964, the plaintiff, Mary E. Swope, and her friend, Rosalind Day, were seated in plaintiff’s automobile eating lunch at a drive-in restaurant in Yakima, Washington. The defendant Gloria Sundgren while attempting to depart from the drive-in parking area backed her automobile into plaintiff’s parked vehicle. The evidence is in dispute as to the violence of the collision.

The plaintiff, who had sustained an “acute lumbar disc syndrome” in an accident in April, 1963, initiated this action contending, in essence, that the collision of January 30, 1964, aggravated and made active her…
