This is an action to recover an assessment upon national bank stock. It succeeded in the trial court, and the defendant appeals. The complaint alleges in substance that The Tucson National Bank, whose capital stock is divided into 1,000 shares, each with a par value of $100, failed on May 2, 1923, and that M. Wehby was at that time the owner of fifty of these shares and continued to be until the filing of this action on January 30, 1924; that on December 13, 1923, the Comptroller of Currency of the United States levied an assessment of $100 upon every share of stock held and owned by the…
