MAGILL, Circuit Judge.

Christopher Machacek appeals the district court’s1 denial of his application for a writ of habeas corpus following his conviction for first degree murder in a Michigan state court. At the district court level, Machacek argued that the Michigan trial court erred in admitting an incriminating statement obtained in violation of his Fourth, Fifth and Sixth Amendment rights.
