Plaintiff, administratrix, filed her petition in the Probate Court, and thereby sought to obtain its declaration of her rights to certain corporate stock which is claimed to be the property of the estate.

After pleading her administrative qualifications, the Tuscarawas Savings & Loan Company’s corporate capacity, and that Ward was the receiver of the Whitehaven Park Association, having been duly appointed by the Common Pleas Court of Cuyahoga county in a proper procóeding, it is averred that plaintiffs decedent, during her lifetime, entered into a verbal agreement with Whitehaven Park…
