This matter is before the court upon the Magistrate Judge’s recommendation that this court grant Defendant’s motion for summary judgment on Plaintiffs retaliation claim under Title VII of the Civil Rights Act of 1964, 42 U.S.C. § 2000e-2, 3. The Magistrate further recommends that Plaintiffs state law claims for breach of contract, breach of contract accompanied by a fraudulent act, and breach of covenant of good faith and fair dealing be dismissed without prejudice to be brought in state court.
