Goldberg, from a judgment of the Supreme'Court iri ‘ favor of; the defendants, entered in the office of the clerk of the county, of New Yoi-k; on the 12th day-of October, 1903, upon the verdict of a jury rendered by direction of the court after a trial at the New York Trial Term.

The action was to recover for the conversion of certain property belonging to the plaintiff. The defendants to justify the taking of the property introduced in evidence an execution issued upon a judgment recovered by the defendant Mary Markowitz in the Municipal Court of the city of New York, which execution was delivered to the defendant Snbin, who was a city marshal, and executed by him. At *239the end, of -all the evidence the defendants made a motion- to direct a verdict for the defendants upon the ground that it appeared that the defendants had acted .under an execution issued…
