This is a motion, made on behalf of a judgment debtor by his attorney appearing specially, to dismiss an order obtained for the examination of the said judgment debtor, “ Henry ” M. Underwood.

The affidavit upon which the order for the examination in proceedings supplementary to execution was granted is entitled “In the matter of supplementary proceedings: Morton Simon, judgment-creditor, against Henry M. Underwood, the name of ‘ Henry ’ being fictitious, said judgment-debtor’s real first name being to judgmenficreditor unknown, judgment-debtor.” The affidavit recites that “ In an action in…
