This is an action of assumpsit instituted on January 22, 1934, by a depositor against a trust company to recover $630, the amount on deposit in two savings accounts. An affidavit of defense was filed setting up under “New Matter” that, when suit was instituted, the defendant was operating on a restricted basis under the provisions of the Sordoni Act (Act of March 8, 1933, P. L. 9) ; that is, that the Secretary of Banking, pursuant to the provisions of this act, had extended payment of all deposits of the defendant, and the plaintiff could not sue for them while the…
