MEMORANDUM OF DECISION

INTRODUCTION

William and Pollyanna Kelvie (“Debtors”) filed their chapter 7 petition for relief on November 10, 2006. Doc. No. 1. The provisions of the Bankruptcy Abuse Prevention and Consumer Protection Act of 2005 (“BAPCPA”), Pub.L. 109-8, 119 Stat. 23 (2005), apply.

On May 11, 2007, the United States Trustee (“UST”) filed an amended motion to dismiss this case under § 707(b) on the basis that granting relief would be an abuse of the provisions of chapter 7. Doc. No. 50 (“Motion”). 1
