Before this court is Bear, Stearns Securities Corp.’s (“Bear Stearns”) appeal of the Bankruptcy Court’s January 9, 2007 Memorandum Decision Denying Defendant’s Motion for Summary Judgment to Dismiss and Granting Trustee’s Motion for Summary Judgment. The cross motions for summary judgment were addressed to Count I of the complaint brought by the Trustee of the Manhattan Investment Fund (the “Fund”). Gredd v. Bear Stearns Securities Corp.
