DOUMAR, District Judge.

In this case, Defendant Demetriel Ste-wert [hereinafter “Defendant”] did not waive, in open court, her right to indictment and agree to be prosecuted by criminal information until the date of her guilty plea hearing and formal waiver of indictment in open court, which happened after the five-year statute of limitations period under 18 U.S.C. 3282 had expired.
