MEMORANDUM OPINION

ELLIS, District Judge.

Petitioner, Jason Darius Sparrow (“Jason”), a Virginia inmate proceeding pro se, filed this petition for writ of habeas corpus pursuant to 28 U.S.C. § 2254 attacking the validity of his conviction in the Circuit Court for the City of Norfolk, Virginia. On February 1, 2006, respondent filed a motion to dismiss pursuant to Rule 12, Fed.R.CivJP., and an answer pursuant to Rule 5, Fed. R. Hab. P.
