STONE, Circuit Judge.
The Cache River Drainage District No. 2 was formed under the authorization of an act of the Arkansas Legislature, which defined the rights, powers, duties and obligations of the district. Koehtitzky was the contractor with the district who made the improvements. The Mercantile Trust Company was trustee under an indenture securing an issue of bonds made by the district.
