Plaintiffs’ class counsel (“class counsel”) appeal from a class action final settlement accepting in part and denying in part their motion/petition (“motion”) for attorney fees based upon the common fund doctrine. During the course of this litigation, class counsel agreed by stipulation not to seek to recover attorney fees from defendants the Board of Trustees of the North Carolina Local Government Employees’ Retirement System and its individual trustees or successors, Dennis Ducker, Harlan E.
