LEWIS, Judge.

In January 1991 plaintiff filed this malpractice action against defendant radiologists and Valdese General Hospital (hereinafter “Valdese”). In October 1992 the trial court denied plaintiff’s motions to compel discovery of certain documents and to continue the case from the 2 November trial date. On 2 November, plaintiff took a voluntary dismissal without prejudice.
