One John Dougherty mortgaged the property in controversy, a lot in the city of South Omaha, to the Nebraska Savings Bank. Afterwards he conveyed the property to his brother, Eugene Dougherty, a resident of Colorado. John Dougherty, the original mortgagor, and Eugene Dougherty, his grantee, each died intestate and without issue.
