Plaintiff-appellant James Napier (“Napier”) filed a suit against defendant-appellee F/V Deesie, Inc. (“Deesie”) in the United States District Court for the District of Massachusetts, seeking damages on three counts of maritime law: one count pursuant to the Jones Act, 46 U.S.C.App. § 688; one count of unseaworthiness; and one count for maintenance and cure. Deesie moved for summary judgment on all three claims.
