The hill was filed, alleging judgment, execution, and nulla Iona return against W. D. Beasley; that he was the owner of certain real estate of the value of $2500 or $3000; that this real estate was encumbered with a trust deed in favor of the other defendants for a debt of about $1500, showing a surplus in value more than sufficient to pay complainant’s debt; and asking that the trust •deed be foreclosed by sale of the property, to the end that a sufficiency of the surplus be applied to the payment of complainant’s debt.
