Pending before the Court is Defendants’ renewed consolidated motion to dismiss and motion for summary judgment (Dock et #25). 1 Plaintiffs have filed an opposition and cross motion for summary judgment (Docket #28). Defendants filed an opposition to Plaintiffs’ cross motion and replied to Plaintiffs’ opposition (Docket # 32) and Plaintiffs sur-replied (Docket # 37).
