Appeal from a judgment of the Supreme Court, rendered at a Trial Term for the county of Cayuga. February 23, 1901, upon a verdict convicting the defendant of the crime of murder in the first degree. The facts, so far as material, are stated in the opinion.

Gray, J.:
The defendant was charged' in the indictment with the crime of murder in the first degree, for having killed Archibald W. Benedict, a. keeper in the State prison at Auburn, on January 9th, 1901, by a blow with an iron bar and with a pistol shot. Being tried upon the indictment, he was found guilty of the crime charged, upon the verdict of a jury, and was sentenced to be put to death. That the defendant killed Benedict is not disputed; nor is it in doubt upon the evidence.
