Defendant, John R. Frye, Jr., appeals from the orders denying his motion to withdraw his guilty plea and revoking his probation. We affirm the order denying the motion to withdraw his plea, but we reverse the revocation of his probation and remand the cause for further proceedings.

Defendant pled guilty to two counts of securities fraud and one count of conspiracy to commit securities fraud. A plea agreement between defendant and the prosecution provided that defendant would receive a 16-year sentence to the Department of Corrections, which would be suspended on the…
