Appeal from a judgment of the Superior Court of Inyo County, and from an order denying a new trial. The facts are stated in the opinion of the court.

The defendant was charged with the murder of one John B. White, convicted, and sentenced to death. His motion for a new trial was denied, and he appeals.

The following points are made in support of this appeal: 1. That the courr below erred in overruling the demurrer to the information; 2. That the court erred in denying the defendant’s motion for a change of venue; 3.
