Appeal from a judgment of the Superior Court of the city and county of San Francisco, and from an order refusing a new trial. The facts are stated in the opinion of the court.

The defendant is under sentence of death for having willfully, unlawfully, and of his malice aforethought killed one Mary Elizabeth Kelly, in the city and county of San Francisco, on the tenth day of November, 1886. It appears that Goldenson and the deceased—who was only fourteen years of age-—had been acquainted for two or three years, and .during that time lived with their parents, in adjoining houses.
