Appellees, Morris and Bagsdale, and. one B. V. Simpson, composing the firm of Morris, Bagsdale & Simpson, mechanics and machinists, and being the owners of the lots sued for in this action, erected thereon a house with machinery and tools for the manufacture of cotton gins, etc. At one time all of them worked in the factory; but about the month of January, 1883, having established a general mercantile business, Simpson took charge of this business and gave it his principal attention.
