BenQ America Corporation (“BenQ”) appeals the final decision of the United States Court of International Trade in BenQ America Corp. v. United States, 683 F.Supp.2d 1335 (Ct. Int’l Trade 2010) (“BenQ ”). In its decision, the court denied BenQ’s motion for summary judgment and granted the government’s cross-motion for summary judgment.
