Scott, J.), rendered September 30, 1985, convicting defendant after a jury trial of criminal possession of a weapon in the third degree, and sentencing him as a predicate felon to a 31A-to-7-year indeterminate term, unanimously reversed, as a matter of discretion in the interest of justice, and the case is remanded for a new trial.
