The plaintiff in this action of assumpsit seeks to recover commissions alleged to be due him because of a sale of real estate by the defendants; he recovered a judgment in the court below and the defendants appeal.

The contract upon which plaintiff alleged the right to recover commissions was in writing and the covenants material to the determination of the rights of the parties in this case were as follows: “The undersigned [the defendants] hereby employs Gr. Prank H. Senderling as the sole and exclusive agent for the sale of the property described on the reverse…
