For the purposes of consideration of this case on review, the following facts are admitted to be true:

On July 17, 1978, Heyward V. Simpson signed a note with the Georgia State Bank of Rome. On February 5, 1979, Mrs. Elizabeth Baskin Simpson, mother of Heyward V. Simpson and Edward B. Simpson, was over 88 years of age, suffering from failing eyesight due to cataracts, and did not have the ability or capacity to read fine print.
