Presently pending in this action is plaintiff Alimenta (U.S.A.), Inc.’s (“Alimenta’s”) motion in limine. Alimenta seeks an Order excluding from evidence

any testimony, documents, or other evidence relating to the Fifth Defense asserted by defendants Wy-Tex Livestock, Inc., Agri-Products, Export, Inc., and Jerry Hayes (collectively, the “Wy-Tex defendants”) that any damage suffered by Alimenta resulted from Alimenta’s alleged negligence in failing to review and monitor properly the transactions involved in this action, in failing to supervise the activities…
