This action arose out of the following statement of facts: The Haekberry *482Consolidated Mining Company and the Senate Silver Mines Company entered into a contract with the Hackberry Consolidated Silver Mines Company whereby it was agreed that the first two named companies would consolidate their holdings consisting of adjoining mining properties, situated at Hackberry, Arizona, and cause the same to he owned by the Hackberry Consolidated Silver Mines Company, a new corporation organized' for that purpose.
