ORDER ON MOTION FOR SUMMARY JUDGMENT

TURNER, District Judge.

Presently before the court in this diversity action is the defendant’s motion for summary judgment pursuant to Rule 56 of the Federal Rules of Civil Procedure.

The plaintiff Ben Sims, Jr. has filed this action alleging that the defendant is liable in negligence under Tennessee tort law for a failure to maintain its loading dock in a safe condition which resulted in injury to the plaintiff.
