This matter is before the court on plaintiffs motion for summary judgment and on defendant Patricia Bates’ motion for summary judgment.
On 15 June 1999, plaintiff Allstate Insurance Company (Allstate) filed this action against defendants William M. Bates and Patricia Bates, seeking a declaratory judgment that Allstate is not required to defend either defendant in a civil suit brought against them by Pamela and Kait-lyn Coe based on Mr. Bates’ sexual molestation of the minor child, Kaitlyn Coe.
