(Joy) 1 appeals the judgment of the United States District Court for the District of Columbia affirming the decision of the Patent and Trademark Office (PTO) Board of Patent Appeals and Interferences (board) which sustained the rejection of claims 1-4,11,12,16 and 18 of U.S. Patent No. 4,042,864 (’864) under 35 U.S.C. § 103 (1988) in a reexamination proceeding.
