David Eugene Price was tried upon two counts of aggravated assault and found “guilty but mentally ill.” He was sentenced to 20 years, to serve ten, and the balance on probation. On appeal he pleads that the evidence he was insane at the time of the offenses was so overwhelming that he should be granted a new trial for the verdict was contrary to the evidence; that the finding that he was competent to stand trial was error; and that the guilty but mentally ill statute is unconstitutional because it permits the jury to compromise on the issues of his sanity and guilt…
