I. INTRODUCTION

This adversary proceeding arises from an altercation between John Carmelo (“Carmelo”), and Anthony Mickletz (“the Debtor”) in March 2006. At the time of the altercation, Carmelo was an employee of Famous Fat Freddie’s Pizza, LLC (“the Restaurant”), a pizza restaurant owned and operated by the Debtor. Carmelo claims that the Debtor pushed him, causing him to fall and suffer injuries that have left him unable to work.
