GRAVES, Justice.

This is an appeal from a judgment of the District Court of Walker County, denying plaintiff, appellant, injunctive-relief against defendants, appellees.

The suit had its inception in the action of the defendants — in their official capacity —in appointing a “jury-of-view,” as provided for by Articles 6703 et seq., Revised Civil Statutes of Texas,, to lay out a road across a tract of land belonging to plaintiff.
