MEMORANDUM OPINION

STEPHEN C. ST. JOHN, Bankruptcy Judge.

This matter came on for hearing on August 13, 2008, upon the Motion for Ab stention filed by the Defendants, F. Wayne McLeskey and McLeskey and Associates, LLC (collectively, the “McLeskey Defendants”), pursuant to 28 U.S.C. § 1334 (“Abstention Motion”), of the Complaint of Plaintiff Tom C. Smith, Jr., Chapter 7 Trustee (“Trustee”) for Bay Vista of Virginia, Inc. This Memorandum Opinion constitutes the conclusions of law of this Court. For the reasons set forth herein, the Abstention Motion is denied.
