The act of 1887 is constitutional. Article 1, § 8, of the constitution gives congress the power “to promote the progress of science and useful arts, by securing for limited times to authors and inventors the exclusive right to ‘their respective writings and discoveries.” The practical result of the decision in Dobson v. Carpet Co., 114 U. S. 439, 5 Sup. Ct. Rep. 945, (decided April 20, 1885,) was io déprive the owner of a design patent of all redress against infringers.
