THIS MATTER comes before the Court on Defendant HSBC Retail Services Inc.’s Motion to Dismiss Complaint and Memorandum of Points and Authorities in Support Thereof, filed July 20, 2012 (Doc. 38)(“Motion to Dismiss”).
